New Legislation Targets Text Message And Phoneline Scams

Minister of State Tony Killeen has expressed his hope that new legislation aimed at clamping down on text message and phoneline scams would be introduced shortly.

The County Clare T.D. was commenting after Communications Minister Eamon Ryan this week presented a Bill to Government to regulate the premium rate telecommunication sector in Ireland.  The bill refers to premium rate content offered by operators for services such as ring tones, traffic news, sports results, competitions advice, entertainment and chat lines.

According to Minister of State Killeen: “I am pleased to see that the self-regulation of the industry on the issue of premium rate services is to be ended. These services have been the subject of thousands of complaints, to RegTel and to the Department of Communications.  I have no doubt that this new legislation will help protect the consumer, particularly children and the elderly, who can be subject to misleading information and exploitation.  Indeed, there have been many cases in County Clare where consumers have been targeted by text message and phoneline scams.”

Minister Killeen said that the planned introduction of fines of up to EUR250,000 and the revocation of licences for fraud would put in place a strong regime for consumer protection and for subscribers to premium rate services.  He added: “This Bill replaces the existing industry model of self-regulation overseen by RegTel and transfers the regulatory functions to the statutory Communications Regulator – ComReg.  This is a major step forward for consumer protection and for regulation of the industry and I am confident it will improve the Irish consumer’s experience of telecommunications in general”.

Provisions of the Bill:
-         For the first time, premium rate service providers will require a licence to operate and will be required to abide by conditions of that service
-         Failure to comply will result in amendment, suspension or revocation of the licence by ComReg
-         Operation without a licence will be punished potential fines of up to €250,000
-         A separate offence will be created for overcharging for a premium rate service
-         Compliance with a new Code of Practice will be a condition for a licence

The Bill will be published in the coming days.

Record calls AND reduce credit card fraud

LATEST NEWS UK: Enterprises who, in the course of their business, take card payments over the telephone need to be aware of PCI DSS.

What is PCI DSS? In a bid to help prevent payment card fraud, the Payment Card Industry (PCI), which is an alliance of major credit card issuers, has established a single set of Payment Card Industry Data Security Standards (PCI DSS). One of these standards (section 3.2) states that companies taking card payments by telephone cannot store any sensitive authentication data, post transaction. They define this sensitive data as being the magnetic stripe and the printed security code on the back of the card – when purchasing an item over the phone, you are often asked for the three digit number on the back of your card. This particular standard does apply to call centres that use call recording.

Businesses who choose to overlook PCI DSS risk fines and even the withdrawal of merchant service privileges.

At first sight, this requirement could present a sizeable headache. It can be addressed in several ways, some more practical than others. You could choose simply not to record calls where payment card transactions are made. Or you could transfer the customer to an automated payment card processing solution. Both of these options do have their limitations. CableFree Solutions have announced an extension order for equipment providing broadband wireless internet in The Netherlands. The order has been received from Dutch partner WiFly, who as a broadband wireless operator, perform “turnkey” installations and maintenance of the systems.

The systems will add to the wireless internet services already installed in many Dutch locations like the Port of Rotterdam Authority, schools, businesses, health authorities and for general public access.

The Wireless Broadband solution enables rapid deployment of cable-free broadband internet with little infrastructure required. The systems already in place have proven to provide high bandwidth (up to 30 Mbps per user), be extremely reliable and have low cost of ownership. This follow up order will enable further end users to benefit from high-speed wireless access.

Harjan Brand at WiFly (Dutch broadband operator) said “We have a significant wireless internet system in Rotterdam in the Netherlands. Furthermore we’ve implemented quite a few radio and optical links. They have proved excellent where high bandwidth rapid installations are required. The systems are based on OFDM radio technology operating in the 5GHz band which enables near-line-of-sight capability and provides very high reliability and enables services demanding excellent Quality of Service such as VoIP (Voice over IP) and Video over IP. Similar in concept to WiMax, the solutions offers higher throughput and lower costs, and are optimised for semi-licensed frequency bands. Installation of the equipment takes typically a few hours, compared with often days or weeks for cabled systems. The total cost of ownership (TCO) of a wireless broadband network is tiny compared to investing in copper or fibre infrastructure, and gives the operator far more flexibility to move and change the network to meet customer needs.

Mobile broadband sales to double in 2009 and overtake fixed broadband by 2012

Broadband comparison website www.broadbandexpert.com.au is predicting sales of mobile broadband to double in 2009 and overtake fixed line broadband services within 3 years.

2008 saw mobile wireless broadband sales increase by around 40% yet Broadband Expert analyst Rob Webber believes this is only the tip of the iceberg with the technology set to experience huge growth in 2009. Webber believes Australia will experience comparable growth to Western European countries where research company CSS Insight estimated around 26 million laptops where connected to mobile data networks by the end of the year with some countries witnessing an 18% month on month growth for the first 6 months of 2008.

Webber believes that “the convenience of being able to access social networking sites like Facebook, visit shopping sites or read the news on the beach, the train or even the pub will see mobile broadband overtake fixed broadband sales within 3 years.”

Mobile broadband, offered by the likes of 3, Dodo, Vodafone, Virgin and Optus, works by simply plugging an internet key into the USB port of a computer or laptop to give access to the provider’s 3G mobile network. Most major Australian cities have coverage though as more is invested in the networks supporting mobile broadband there should be a significant increase in coverage and speeds. Furthermore prices are falling as providers fight for a share of this growing market. Webber cites the example of 3 who have recently followed Vodafone and Optus in cutting prices and plan to double the maximum speed of their mobile broadband network from 3.6Mbs to 7.2Mbs in 2009.

With mobile broadband being so well suited to laptops Broadband Expert is predicting that mobile broadband sales will be boosted further by an increase in packages offering a laptop as part of the deal. These deals are likely to prove attractive as the consumer can spread the cost of a new laptop over the length of their mobile broadband contract. Such deals proved so popular in the UK that many retailers ran out of stock in the run up to Christmas. Similar deals are already being offered by Dodo in Australia with Vodafone set to follow suit in early 2009 by offering a Dell Netbook (miniature laptop) with built in mobile broadband.

However, Webber does issue a word of warning to mobile broadband users to keep track of their usage since “exceeding download limits can prove expensive with additional charges for exceeding these limits often very costly”. The lower download limits of mobile broadband (in comparison to home broadband) mean the technology is less suitable for heavy internet users including those who regularly download films and online gamers who are better suited to faster home broadband services with high download limits. This problem is likely to be addressed in 2009 as the providers improve their networks and higher data usage packages become available.
